How to Lodge or Join an Appeal on Te Tai o Poutini Plan Committee Decisions
The period for registering an appeal on Te Tai o Poutini Plan or joining an appeal as a s274 party is now closed.
Decisions version of TTPP Notified
On 10 October 2025 the Te Tai o Poutini Plan (TTPP) Committee notified its decisions on the proposed TTPP, including Variations 1 and 2.
What happens now that the TTPP Committee has made its decisions?
The next step in the process is appeals through the Environment Court. If you were a submitter and disagree with TTPP Committee decisions on your submission, you can appeal the part of the decision you oppose to the Environment Court within 30 working days of decisions being notified.
Importantly, the process is managed by the Environment Court, not the TTPP Committee or West Coast Regional Council.
Who can make an appeal?
Any person who made a submission on the proposed TTPP can appeal the TTPP Committee’s decision, provided the submission referred to the provision or matter it seeks to appeal. It is not possible to lodge an appeal seeking withdrawal of the Plan in its entirety.
You can also join an appeal as a Section 274 Party if you support, oppose or are neutral on the nature of an appeal lodged by another party. You could become a Section 274 party if you lodged a submission on the proposed TTPP on the same subject matter as the appeal, or if you have an interest in the appeal greater than the public generally.
After the close of the appeal period there is a 15 working day period for someone to apply to become a Section 274 Party to an appeal.
A Section 274 Party is a party to the appeal, and has the right to be involved throughout the Environment Court process determining the appeal.
The appeal process is managed by the Environment Court (not the TTPP Committee or the West Coast Regional Council). It is a legally complex process and it is recommended that potential appellants and section 274 parties seek legal advice and understand the costs of participation in an appeal.

A copy of the Appeal must be served on:
- The TTPP Committee electronically – by email to info@ttpp.nz
- All further submitters who submitted on the submission point concerned, if your Appeal is in relation to a submission point of yours
- The original submitter plus all other further submitters who submitted on that submission point if your Appeal is in relation to a further submission point of yours.
Appeals on TTPP need to be lodged with the Environment Court by 5.00pm, Monday 8 December 2025.

- The TTPP Committee electronically – by email to info@ttpp.nz
- The Appellant whose Appeal you wish to join
Note that Appeals lodged need to include contact details of Appellants, so the copying of s274 Notices to Appellants will be easily achieved. Section 274 notices, to become a party to proceedings on appeals on the TTPP, must be lodged with the Environment Court by 5.00pm, Monday 2 February 2026.
Such notification for Appeals and s274 Notices has been streamlined in accordance with Decision No [2025] NZEnvC 325. Basically:
- Notification of those directly affected parties listed above is required; but
- The requirements to serve notification on any other parties otherwise listed on Forms 7 (Appeals) and 33 (s274 Party) of the Resource Management (Forms Fees and Procedure) Regulations 2003 has been waived by the Environment Court – due to the TTPP Committee agreeing to publish lists of both Appeals and s274 Notices on its Website.

What applications forms are needed?
Appeals and Notices to become a Party to Proceedings must be lodged with the Environment Court in the appropriate forms as set out in the Schedule 1 of the Resource Management (Forms, Fees and Procedure) Regulations 2003.
Form 7 is for lodging an Appeal, and Form 33 for joining as a Party to Proceedings.

- The information you need to provide.
- Supporting documentation which needs to be attached.
- Who you need to serve copies of your appeal or s274 notice on.
- Timeframes for filing notices and serving copies on other parties.

Where can I view Appeals and s274 Notices that have been lodged?
Due to the waivers granted by the Environment Court all appeals and s274 notices must be published on the TTPP website within three days of receipt by the TTPP Committee. Appellants will need to watch the TTPP Website for details of the appeals and Section 274 Notices received.
How does the Environment Court deal with appeals?
Generally the Environment Court will seek resolution to appeals by alternative dispute resolution (mediation) first. If agreement cannot be reached in mediation, formal proceedings in the Environment Court take place.
