Variation 1 – Activities on the Surface of Water (ASW)

Variation 1 to the proposed Te Tai o Poutini Plan is in relation to Activities on the Surface of Water policy and rules.  This is to clarify that commercial and other activities associated with the Westport Harbour Port and the Port of Greymouth are Permitted Activities. 

Only those persons or organisations who were given limited notification under clause 5A(3) of Schedule 1 of the RMA and who are listed below may make a submission on this proposal:

    • Immediately adjoining the Erua Lagoon, near Greymouth
    • Immediately adjoining the Grey River between the State Highway 7 Bridge and the coastal marine area

What is proposed?

A new rule would be added to the TTPP that specifically allows for port activities and vessels entering and using Westport and Greymouth Ports as a Permitted Activity.  A supporting policy has also been developed and the title to another rule rule would be amended.  The Variation involves the insertion of a new policy and rule, and amendment of Rule ASW – R6 as follows (additions are underlined).

New policy:

ASW P4 – Enable the use of the Port of Greymouth and Westport Harbour Ports and their use of the Māwheranui/Grey and Kawatiri/Buller Rivers for port activities and commercial activities associated with the ports.

New rule:

ASW – R4A Use of Watercraft for Commercial Activities and Port Activities on the Surface of Water

Activity Status: Permitted

Where: This is the use of the surface of water for commercial activities on water and other Port Activities

  1. Associated with Port of Greymouth and harbour, and seaward of the State Highway 6 Bridge on the Māwheranui/Grey River and including within the Erua Moana Lagoon; or
  2. Associated with Westport Port and harbour, and seaward of the State Highway 67 Bridge on the Kawatiri/Buller River.

Amendment to the title of Rule ASW – R6:

ASW – R6 Commercial Activities on the Surface of Rivers, Lagoons and Lakes not associated with Westport Harbour Port and Port of Greymouth
